1. Identity and scope

This website is provided by Pedro Ivo Vidal Coelho Sciammarella, trading as Pedro Ivo Spatial, a Dutch sole proprietorship based in Tilburg.

These website terms apply to visits to and use of the website. A written proposal, order confirmation or agreement also applies to a specific service. If they conflict, that specific written agreement prevails.

2. Information and enquiries

The website describes potential spatial documentation, capture and handover services. Its content is general information and is not individual advice, a binding offer or a guarantee of availability, price, timing or fitness.

Submitting an enquiry does not oblige you or Pedro Ivo Spatial to enter a contract. We may ask for more information, suggest another approach or reasonably decline an enquiry. You are responsible for the accuracy and lawful provision of the information you submit.

3. Proposals and contracts

A contract is formed only when a valid written proposal or order confirmation is accepted in writing within its stated validity period, or when the parties otherwise expressly agree in writing. A proposal defines matters such as scope, deliverables, timing, price, VAT, payment, handover, optional hosting and project-specific limitations.

Changes or extra work are confirmed in writing before performance where reasonably possible. Amounts are exclusive or inclusive of VAT as stated in the proposal. An obvious writing, calculation or publication error is not binding.

4. Nature and limits of the services

Spatial capture and documentation provide a useful representation within the agreed scope and the technical, physical and visual conditions at the time of capture. Unless expressly agreed in writing, they are not a structural survey, land survey, certified measurement, safety inspection, valuation, legal evidence or a guarantee that every condition or defect is visible.

Interference, limited access, lighting, movement, reflective surfaces, network or platform constraints, and later changes may affect the result. We disclose known material limitations relevant to the agreed purpose.

5. Your responsibilities

Where relevant to the assignment, you arrange in good time:

• safe and lawful site access and suitable conditions for performance;
• permission from the owner, manager and identifiable people for capture, processing and agreed publication or handover;
• advance notice of safety risks, access rules and sensitive or prohibited areas;
• accurate contact, billing, timing and scope information;
• timely review of drafts, corrections and handover.

Delay or extra work caused by missing access, permission, information or safe conditions may affect timing and charges under the specific proposal.

6. Intellectual property, material and portfolio use

Rights in pre-existing methods, software, templates, brands and materials remain with their original owner. The proposal defines the usage rights or files you receive after payment. You may not remove rights notices or use material outside the agreed licence or purpose.

Project imagery, client names or results are used in a portfolio, publicity or a public case only when appropriate permissions and rights have been recorded. Without that permission, the material stays out of public presentation.

7. External services and links

The website or an assignment may link to or use third-party services, including optional hosting or 360 presentation. Additional provider terms and privacy notices may apply. We cannot guarantee availability, changes or failures beyond our reasonable control. Where possible, a portable offline core deliverable is used so that optional hosting is not a necessary dependency.

8. Availability and acceptable use

We aim to provide a secure and usable website but do not guarantee uninterrupted or error-free availability. You must not misuse the website, bypass security, introduce harmful code, unlawfully submit another person’s data, cause automated overload or infringe third-party rights.

9. Liability

Nothing in these terms excludes liability or limits rights where mandatory law does not allow that. Within that limit, we are not liable for loss caused solely by reliance on general website information, inaccurate or incomplete user information, use outside the agreed purpose, or failure to follow disclosed limitations.

Any project-specific liability terms are stated in the proposal or agreement. Statutory consumer rights remain fully effective.

10. Consumers

If you act as a consumer, you receive the information required by law before entering a contract. Any rights for a distance contract, including a cooling-off period, apply where provided by law. Performance during a cooling-off period starts only at your express request and with the confirmations required by law. These website terms do not restrict mandatory consumer rights.

11. Privacy

Our privacy notice explains how personal data is processed. Submitting an enquiry does not provide consent to marketing.

12. Governing law, complaints and disputes

Dutch law applies to these website terms. A dispute is submitted to the court that has jurisdiction under applicable law. Mandatory consumer rules about jurisdiction and governing law continue to apply.

13. Changes

We may update these terms when the website, services or law changes. The current version and effective date appear on this page. The version governing a specific assignment is determined by the written terms for that assignment.
